The subject property comprised a severely contaminated site on an industrial estate to the north of Bognor Regis, where the client had obtained planning consent for a food retail store, which had then been called in by the Secretary of State.

Tim Hitchcock was instructed by the client to give evidence at the Planning Inquiry, relating to the appraisal of the site for a variety of uses to demonstrate that, in practice, the site was extremely unlikely to come forward for any form of alternative development in event that the development of a food store did not proceed.

The Planning Inspector recommended the grant of the planning consent on several grounds including lack of development viability for alternative uses.
